What You Need to Show
A premises liability claim generally turns on three points:
A hazardous condition existed: Such as a slick floor, uneven pavement, loose handrail, or poor lighting.
The owner knew about it, or should have known: If an employee created the hazard, knowledge is usually assumed. If a customer or someone else caused it, the owner must have had actual or constructive notice and failed to fix it.
The hazard caused your injury: Supported by medical records that connect the fall to what you are being treated for.
Where Falls Happen
- Grocery and retail stores: Spills, dropped produce, freshly mopped floors, cluttered aisles
- Hotels, resorts, and casinos: Polished floors, pool areas, wet entryways, crowded walkways
- Apartments and condominiums: Broken stairs, poor lighting, loose railings, uneven walkways maintained by a landlord or association
- Parking lots and garages: Potholes, cracked pavement, unmarked curbs
- Private homes: Unsafe stairs or walkways, usually covered by the homeowner’s insurance

What to Do After a Fall
- Report it before you leave and ask for the incident report number.
- Photograph the hazard and the area around it, including any warning signs or the lack of them.
- Keep your shoes and clothing as they were at the time of the fall.
- Get the names and phone numbers of anyone who saw the fall.
- See a doctor promptly, even if the pain seems minor at first.
- Do not give a recorded statement to the property’s insurer before speaking with a lawyer.

Falls commonly cause broken wrists, hips, and ankles, back and neck injuries, knee injuries, and concussions. Older adults face a higher risk of serious fractures and long recovery times.

Sharing Fault and Filing Deadlines
Property owners and their insurers often argue that the injured person was not watching where they were going. Under NRS 41.141, that argument can reduce a recovery but does not end it unless your share of the fault exceeds that of the property owner and others being sued.
Nevada generally allows two years from the date of the fall to file a personal injury lawsuit (NRS 11.190(4)(e)). Surveillance footage and cleaning logs are often kept for much less time than that.

Slip and Fall FAQs
Do I have a case if I fell at a friend’s or neighbor’s home?
You may. The same duty of reasonable care applies to private homes, and these claims are usually paid by the homeowner’s insurance policy rather than by the homeowner personally.
What if I fell on a public sidewalk or in a government building?
Claims against a city, county, or the state follow different procedures, and Nevada law generally limits damages in these cases to $200,000 and does not allow punitive damages (NRS 41.035). Speak with a lawyer early, because these claims have their own requirements.
Can I file a claim if I fell at work?
Injuries at work are generally handled through workers’ compensation rather than a lawsuit against your employer. If someone other than your employer, such as a property owner or contractor, caused the hazard, you may also have a separate claim against them.
The business had a wet floor sign. Does that end my claim?
Not automatically. Whether a warning was enough depends on where it was placed, whether it could be seen, and whether the business should have done more, such as cleaning the spill or blocking off the area.
I didn’t report the fall before I left. Can I still make a claim?
Yes. Report it in writing as soon as you can, write down the date, time, and exact location, and keep any receipts or photos that show you were there.
