How a Car Accident Claim Works in Nevada

Under Nevada’s fault-based system, the person who caused the collision is liable for the injuries and losses that follow, and in most cases that driver’s insurer is the one paying. After a collision, compensation usually comes from one or more of these sources:

  • The at-fault driver’s liability insurance: This is the main source in most claims.
  • Your own policy: Medical payments coverage, collision coverage, and uninsured or underinsured motorist coverage may apply depending on what you carry.
  • A lawsuit: If the insurer will not offer a fair amount, the claim can be filed in court.

Most claims involve more than one of these, and the order they are used in can change the total recovery.

Nevada Insurance Rules That Affect Your Claim

Minimum coverage: Every Nevada driver must carry at least $25,000 per person and $50,000 per accident for bodily injury, and $20,000 for property damage (NRS 485.185). The minimum is only the floor. We work to confirm the at-fault driver’s actual policy limits early, because those limits shape how the claim is valued and which other coverage needs to come into play.

Uninsured and hit-and-run drivers: Nevada’s uninsured motorist law (NRS 690B.020) covers crashes with uninsured drivers and hit-and-run vehicles. If you carry this coverage, it can pay for injuries the other driver cannot.

Uber and Lyft crashes: Rideshare coverage depends on what the driver was doing. Under NRS 690B.470, once a driver has accepted a ride or has a passenger in the car, at least $1.5 million in liability coverage must be in place. While the app is on and the driver is waiting for a request, the required limits are $50,000 per person, $100,000 per accident, and $25,000 for property damage. With the app off, only the driver’s personal policy applies.

Proving Who Was at Fault

Fault in Nevada is shared by percentage under NRS 41.141. An injured person can still be compensated if they were no more at fault than the other side, but their award goes down by their own share. That is why the other driver’s insurer will often look for any reason to assign part of the blame to you.

Evidence that helps establish fault includes:

  • The police report and any citations issued
  • Photos of vehicle damage, the scene, and road conditions
  • Dashcam, traffic camera, or nearby business surveillance footage
  • Witness statements
  • Vehicle data showing speed and braking before the impact

Protecting Your Claim in the Days After a Crash

Get medical care and keep your appointments: Your medical records are the main proof of what the crash did to you, so follow the treatment plan your doctor sets.

Keep every record: Including medical bills, repair estimates, rental car receipts, and time missed from work.

Be careful with the other driver’s insurer: You are not required to give them a recorded statement, and you should not sign a broad medical records authorization before speaking with a lawyer.

Stay off social media about the crash: Posts and photos can be used to question your injuries.

Can I still recover if I wasn’t wearing a seatbelt?

Yes. Under NRS 484D.495, not wearing a seatbelt cannot be treated as negligence or as a cause of the crash in a Nevada civil case. Insurers sometimes raise it anyway, but it is not a valid basis for assigning you fault.

I was a passenger. Who do I file a claim against?

Passengers are rarely at fault, so a passenger can usually claim against the insurance of whichever driver caused the crash, and sometimes both drivers if fault is shared. Your own medical payments or uninsured motorist coverage may also apply.

What if the driver who hit me was working at the time?

I was visiting Las Vegas when the crash happened. Can I still file a claim?

Yes. The claim is handled under Nevada law because the crash happened here, and much of the process can be handled after you return home.

What if the insurance company denies my claim?

A denial is not the final word. We review the reason given, gather evidence that answers it, and check other coverage such as your own uninsured motorist policy. If the insurer still will not pay fairly, the claim can be filed in court before Nevada’s two-year deadline.
